Public Comment Period – Virginia Throws Out Former Alcoholic Beverage Advertising Regulations and Promulgates Anew
The Virginia Department of Alcoholic Beverage Control has promulgated new regulations regarding alcoholic beverage advertising. According to the agency statement, “Changes are designed to simplify the regulation, and lessen restrictions in line with U. S. Supreme Court decisions on the protection of commercial speech. Alcoholic beverage manufacturers, wholesalers, importers, and retailers will likely engage in more outdoor advertising of beverage products. The regulation seeks to minimize impacts on children by restricting sign locations in areas where children congregate regularly.”
Among the changes, specific language prohibiting retailers from advertising happy hour, reduced prices or specials is removed. The public comment period ends August 16, 2013. For full details and how to comment, please review the official documents.
